These terms are an agreement between you and STOPLOSSESAI LLC.
การใช้บริการ AskElira Thailand ถือว่าคุณยอมรับข้อตกลงนี้ หากไม่ยอมรับ กรุณาอย่าใช้บริการ By using AskElira Thailand you agree to these terms. If you do not agree, please do not use the service.
1. บริการ / The service
เราให้บริการผู้ช่วย AI ที่เชื่อมกับช่องทางแชทของธุรกิจคุณ — LINE Official Account และ (เมื่อคุณเลือกเชื่อมต่อ) Facebook Messenger และ Instagram — เพื่อตอบลูกค้าอัตโนมัติตลอด 24 ชั่วโมง เป็นภาษาไทยและอังกฤษ ตามข้อมูลที่คุณให้ We provide an AI assistant connected to your business's messaging channels — your LINE Official Account and, where you choose to connect them, Facebook Messenger and Instagram — answering customers automatically 24/7, in Thai and English, based on the information you provide.
2. การสมัครและการชำระเงิน / Subscription & payment
- ค่าบริการ ฿2,500 ต่อเดือน (ประมาณ $75 USD) ไม่มีค่าติดตั้ง ฿2,500 per month (~$75 USD), no setup fee.
- เรียกเก็บแบบต่ออายุอัตโนมัติทุกเดือนผ่าน Stripe จนกว่าคุณจะยกเลิก Billed automatically each month via Stripe until you cancel.
- ยกเลิกได้ทุกเมื่อ การยกเลิกมีผลเมื่อสิ้นสุดรอบบิลปัจจุบัน ไม่มีการคืนเงินสำหรับรอบที่ใช้ไปแล้ว Cancel anytime; cancellation takes effect at the end of the current billing period. No refunds for the period already used.
ภาษีมูลค่าเพิ่ม (VAT): ราคาที่แสดงยังไม่รวมภาษีที่เกี่ยวข้อง เมื่อกฎหมายไทยกำหนด (บริการอิเล็กทรอนิกส์จากต่างประเทศ, e-Service) เราจะเพิ่มภาษีมูลค่าเพิ่มในอัตราปัจจุบัน (7%) เข้ากับค่าบริการ และจัดทำหลักฐาน/ใบกำกับภาษีเท่าที่กฎหมายกำหนด VAT: Prices shown are exclusive of applicable taxes. Where required by Thai law (including the foreign e-Service VAT regime), we will add value-added tax at the prevailing rate (currently 7%) to the fee and provide a tax record/invoice to the extent required.
3. ความรับผิดชอบของคุณ / Your responsibilities
- คุณรับผิดชอบความถูกต้องของข้อมูลธุรกิจ ราคา และโปรโมชั่นที่ป้อนให้ AI You are responsible for the accuracy of the business info, prices, and promotions you give the AI.
- คุณต้องมีสิทธิ์ใช้ LINE Official Account ที่เชื่อมต่อ และปฏิบัติตามข้อกำหนดของ LINE You must own/control the connected LINE Official Account and comply with LINE's terms.
- ห้ามใช้บริการเพื่อเนื้อหาผิดกฎหมาย หลอกลวง หรือละเมิดสิทธิผู้อื่น Do not use the service for illegal, deceptive, or infringing content.
4. ข้อจำกัดของ AI / AI disclaimer
คำตอบสร้างโดย AI โดยอัตโนมัติและอาจมีข้อผิดพลาด AI ตอบจากข้อมูลที่คุณให้เท่านั้น และไม่ใช่คำแนะนำทางวิชาชีพ (เช่น การแพทย์หรือกฎหมาย) ธุรกิจเป็นผู้รับผิดชอบการสื่อสารกับลูกค้าของตน Replies are generated automatically by AI and may contain errors. The AI answers only from the information you provide and is not professional advice (e.g. medical or legal). The business remains responsible for its communications with its customers.
5. ความพร้อมให้บริการ / Availability
เราพยายามให้บริการต่อเนื่อง แต่ไม่รับประกันว่าจะไม่มีการหยุดชะงัก เราอาจปรับปรุงหรือหยุดบางฟีเจอร์เป็นครั้งคราว We aim for continuous availability but do not guarantee uninterrupted service. We may modify or pause features from time to time.
6. ข้อจำกัดความรับผิด / Limitation of liability
เท่าที่กฎหมายอนุญาต เราไม่รับผิดต่อความเสียหายทางอ้อมหรือสืบเนื่องจากการใช้บริการ และความรับผิดรวมของเราจำกัดไม่เกินค่าบริการที่คุณชำระในเดือนที่เกิดเหตุ To the extent permitted by law, we are not liable for indirect or consequential damages, and our total liability is limited to the fees you paid in the month the issue arose.
ข้อสงวนสิทธิผู้บริโภค: ไม่มีข้อความใดในข้อตกลงนี้ที่จำกัดหรือยกเว้นความรับผิดที่ไม่อาจจำกัดหรือยกเว้นได้ตามกฎหมายไทยที่ใช้บังคับ รวมถึง พ.ร.บ. คุ้มครองผู้บริโภค พ.ศ. 2522 พ.ร.บ. ว่าด้วยข้อสัญญาที่ไม่เป็นธรรม พ.ศ. 2540 และ พ.ร.บ. คุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (PDPA) ข้อจำกัดข้างต้นใช้บังคับเพียงเท่าที่กฎหมายบังคับของไทยอนุญาต Consumer savings clause: Nothing in these terms limits or excludes any liability that cannot be limited or excluded under applicable Thai law, including the Consumer Protection Act B.E. 2522, the Unfair Contract Terms Act B.E. 2540, and the Personal Data Protection Act B.E. 2562 (PDPA). The limitations above apply only to the extent permitted by mandatory Thai law.
7. การยุติบริการ / Termination
คุณยกเลิกได้ทุกเมื่อ เราอาจระงับหรือยุติบริการหากมีการละเมิดข้อตกลงนี้หรือข้อกำหนดของ LINE You may cancel anytime. We may suspend or terminate the service for breach of these terms or of LINE's terms.
8. กฎหมายที่ใช้บังคับและเขตอำนาจศาล / Governing law & jurisdiction
ข้อตกลงนี้อยู่ภายใต้กฎหมายของประเทศไทย ข้อพิพาทที่เกิดจากหรือเกี่ยวข้องกับบริการนี้ให้อยู่ในเขตอำนาจของศาลไทย ทั้งนี้ไม่กระทบต่อสิทธิของผู้บริโภคที่จะฟ้องต่อศาลตามภูมิลำเนาของตนตามที่กฎหมายไทยกำหนด These terms are governed by the laws of Thailand. Disputes arising out of or relating to the service are subject to the jurisdiction of the Thai courts. This does not affect any right of a consumer to bring proceedings in the courts of their domicile where Thai law so provides.
